Welcome to Equestrian Diva Couture (“EDC”, “we”, “us”, or “our”). These Terms & Conditions govern your use of our website and the purchase of products from our online and physical store.

By accessing or using our website, or by purchasing from us, you agree to be bound by these Terms & Conditions.

2. APPLICABLE LAW

These Terms & Conditions are governed by and interpreted in accordance with the laws of the Republic of South Africa, including but not limited to:

  • The Consumer Protection Act 68 of 2008 (CPA)
  • The Protection of Personal Information Act 4 of 2013 (POPIA)
  • The Electronic Communications and Transactions Act 25 of 2002 (ECTA)

3. USE OF THE WEBSITE

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use of this website by any third party.

You may not:

  • Misuse the website
  • Attempt to gain unauthorised access
  • Interfere with the website’s functionality or security

4. PRODUCT INFORMATION & AVAILABILITY

  • All products are subject to availability.
  • We take reasonable care to ensure product descriptions, images, and pricing are accurate.
  • Images are for illustrative purposes; colours and finishes may vary slightly.
  • EDC reserves the right to correct errors or inaccuracies at any time without prior notice.

5. PRICING & PAYMENT

  • All prices are displayed in South African Rand (ZAR).
  • Prices include VAT unless stated otherwise.
  • Payment must be received in full before orders are processed or dispatched.
  • We reserve the right to refuse or cancel any order for any lawful reason.

6. DELIVERY

  • Delivery timelines are estimates and not guaranteed.
  • Risk passes to the customer upon delivery.
  • We are not responsible for delays caused by third-party couriers.
  • Customers must ensure delivery details are accurate.

7. RETURNS, EXCHANGES & REFUNDS (CPA COMPLIANCE)

7.1 Cooling-Off Period (Online Sales)

In accordance with the CPA, you may cancel an online order within 7 business days of delivery, provided:

  • The product is unused
  • In its original packaging
  • In a resaleable condition

Return shipping costs are the responsibility of the customer unless the item is defective or incorrect.

7.2 Defective or Incorrect Goods

If a product is defective or incorrectly supplied:

  • You may request a repair, replacement, or refund
  • This must be reported within 6 months of delivery as per the CPA

7.3 Exclusions

For hygiene and safety reasons, certain items (such as intimate apparel or worn items) may not be eligible for return unless defective.

7.4 Product-Specific Return Conditions

7.4.1 Helmets (Safety Items)

Helmets are classified as safety equipment and are subject to strict return limitations.

  • Helmets may not be returned or refunded once fitted, worn, or used.
  • Helmets showing any signs of use, impact, handling, or riding will not be accepted for return.
  • Returns will only be considered if the helmet is unused, in its original packaging, and in a resaleable condition.
  • Damage arising from use, impact, mishandling, or wear does not constitute a manufacturing defect.

Only genuine manufacturing defects, as contemplated under the Consumer Protection Act, will be considered.

7.4.2 Boots & Riding Footwear

Riding boots and footwear are high-wear items and are subject to the following conditions:

  • Normal wear and tear, riding use, mud, water exposure, sweat, strain on zips or laces, and incorrect care are not manufacturing faults.
  • Zips, laces, soles, and materials affected by riding or environmental exposure are excluded from refunds.
  • Items must be returned clean, unused, and in resaleable condition for any return to be considered.

Only genuine manufacturing defects in materials or workmanship will be assessed under the CPA.

7.4.3 High-Wear & Hygiene-Sensitive Items

Certain products may be excluded from returns for hygiene and safety reasons, including but not limited to:

  • Items worn against the body
  • Items exposed to sweat, dirt, or riding conditions
  • Items that cannot be resold for hygiene or safety reasons

These items may only be returned if proven to be defective and unused.

7.4.4 General Clarification

For the avoidance of doubt:

  • Manufacturing defects refer to faults present at the time of sale (materials/workmanship).
  • Wear and tear, misuse, riding damage, and environmental exposure do not qualify as defects.
  • General return rules do not override product-specific conditions.

8. FITTING ROOM & IN-STORE EXPERIENCE

EDC offers an in-store fitting experience designed for comfort and confidence.

All fittings are conducted with professionalism and respect. Participation is voluntary and at the customer’s discretion.

9. INTELLECTUAL PROPERTY

All content on this website, including logos, images, text, graphics, and branding, is the intellectual property of Equestrian Diva Couture unless otherwise stated.

You may not copy, reproduce, distribute, or exploit any content without prior written permission.

10. PERSONAL INFORMATION & POPIA

We collect and process personal information in accordance with POPIA.

Personal information is used only for:

  • Processing orders
  • Customer communication
  • Legal and operational purposes

We do not sell or unlawfully share your personal information. Full details are set out in our Privacy Policy.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • EDC shall not be liable for indirect, incidental, or consequential damages.
  • Our liability is limited to the value of the product purchased.

Nothing in these Terms limits rights that cannot legally be excluded under the CPA.

12. FORCE MAJEURE

EDC shall not be liable for failure or delay in performance due to events beyond our reasonable control, including natural disasters, strikes, supplier delays, or system failures.

13. AMENDMENTS

We reserve the right to update or amend these Terms & Conditions at any time. The latest version will always be available on our website.
